1. About ERA Grizzard Real Estate
ERA Grizzard Real Estate, operating as Tom Grizzard, Inc. (“ERA Grizzard,” “we,” “us,” or “our”), is a licensed Florida real estate brokerage headquartered at 1300 Citizens Blvd., Leesburg, FL 34748. We provide residential and commercial real estate brokerage services, property management services, and recruiting and support services for affiliated real estate agents throughout Central Florida, including Lake, Sumter, Orange, Seminole, and Volusia counties.
We operate as an independently owned and operated franchise of ERA Real Estate and are licensed by the Florida Department of Business and Professional Regulation under Florida Statute Chapter 475.

2. Acceptance of Terms
By accessing or using eragrizzard.com (our “Website”), our services, or any communications channels we operate (including email and SMS text messaging), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Website or services.

3. Our Services
ERA Grizzard provides the following services:

• Real estate brokerage services representing buyers, sellers, landlords, and tenants in residential and commercial transactions in Florida.
• Property management services for residential and commercial properties on behalf of property owners.
• Recruiting and onboarding of licensed Florida real estate professionals seeking brokerage affiliation.
• Agent support services for our affiliated real estate agents, including transaction support, marketing, training, and administrative services.

All real estate brokerage services are provided in accordance with Florida Statute Chapter 475, the rules of the Florida Real Estate Commission, and our brokerage relationship disclosures (single agent, transaction broker, or no brokerage relationship).

4. Use of Our Website
You agree to use our Website only for lawful purposes and in a way that does not infringe on the rights of, restrict, or inhibit anyone else’s use of the Website. Prohibited uses include attempting to gain unauthorized access to our systems, transmitting harmful code, scraping property data for resale or unauthorized redistribution, or impersonating any person or entity.
Property listings displayed on our Website are provided through the Multiple Listing Service (MLS) and other authorized sources. Listing information is believed to be accurate, but is not guaranteed and is subject to change without notice. Buyers and tenants should independently verify all material facts.

5. Intellectual Property
The content on our Website, including text, graphics, logos, photographs, and the ERA Grizzard brand, is the property of Tom Grizzard, Inc., its licensors (including ERA Real Estate), or its contributing agents and may not be reproduced, distributed, or used for commercial purposes without our written permission.

6. SMS / Text Messaging Communications
ERA Grizzard Real Estate operates an SMS program for three purposes:

1. Recruiting conversations with licensed Florida real estate professionals who have opted in by submitting their number through our careers page, responding to a recruiting inquiry, or providing consent during a recorded conversation with our broker.
2. Customer care messages to our affiliated agents regarding their active transactions, broker support requests, and office operations.
3. Account notifications to affiliated agents regarding their listings, pending closings, and brokerage announcements.

How to opt in
You may opt in to receive SMS messages from ERA Grizzard Real Estate by:

• Submitting your mobile number through our careers page form at eragrizzard. com and checking the SMS consent box,
• Responding affirmatively to a recruiting inquiry, or
• Providing verbal or written consent during a conversation with our broker, recruiting team, or onboarding staff.

Program description
SMS communications are sent for the three purposes described above and are not used for general advertising or third-party marketing.

Message frequency
Message frequency varies based on the nature of your relationship with ERA Grizzard Real Estate. Recruiting conversations may include occasional follow-up messages. Affiliated agents may receive transaction and operational messages as business activity requires.

Cost
Message and data rates may apply. Check with your wireless carrier for details. ERA Grizzard Real Estate does not charge a fee for SMS messages.

Opt out
You can opt out of SMS messages at any time by replying STOP to any message. After replying STOP, you will receive one final confirmation message and no further messages unless you opt in again.

Privacy and data sharing
Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services. Carrier liability: Carriers are not liable for delayed or undelivered messages.

7. Email Communications
If you provide your email address through our Website or by working with us, we may send you transactional emails related to your services and marketing emails about properties, market updates, and brokerage opportunities. 8. Disclaimers

9. Limitation of Liability
To the fullest extent permitted by law, ERA Grizzard Real Estate, its officers, employees, affiliated agents, and franchisor will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Website, our services, or our communications. Our total liability for any claim arising from these Terms and Conditions will not exceed the amount you paid us, if any, for the services giving rise to the claim.

10. Governing Law
These Terms and Conditions are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of our Website or services will be resolved in the state or federal courts located in Lake County, Florida.
